The Consumer Justice Foundation, a for-profit corporation whose team of professional consumer advocates provide free online informational resources for consumers regarding the potential dangers of using certain prescription medications, hereby alerts the public that another Actos side effects lawsuit has been filed against Takeda Pharmaceutical, the manufacturer of this medication. This individual Actos bladder cancer lawsuit will now become part of the existing MDL regarding Actos.
Specifically, the latest Actos side effects lawsuit that was filed was initiated on April 25, 2012. The plaintiff, Donald Shingleton of West Virginia, filed a lawsuit in Louisiana Western District Court (case no. 6:2012cv01001) alleging he suffered bladder cancer after taking Actos for several years beginning in 2005.
The plaintiff began using Actos to treat his type 2 diabetes, which is what the drug has been used for since its approval for sale in the United States by the Food and Drug Administration. He alleges that his use of Actos led to his bladder cancer diagnosis, and he is seeking damages compensating him for his injuries and for his emotional distress.
The case will now become part of the existing MDL for Actos. This multi-district litigation was initiated on December 29th, 2011, the Judicial Panel on Multidistrict Litigation (JPML) established an MDL (MDL 2299). U.S. District Judge Rebecca Doherty presides over approximately 150 cases. This Actos MDL remains open for additional individual claims that could be filed.
