National Actos Attorneys File Lawsuit on Behalf of Louisiana Woman who Developed Bladder Cancer Allegedly Due to The Diabetes Drug Actos

Parker Waichman LLP, a national law firm dedicated to protecting the rights of victims injured by defective drugs, has filed a lawsuit on behalf of a woman who suffers from bladder cancer, allegedly due to Actos. The suit names Takeda Pharmaceuticals America, Inc., Takeda Pharmaceuticals USA, Inc., Takeda Pharmaceuticals North America, Inc., Takeda Pharmaceutical Company Limited and Eli Lilly and Co. as Defendants. The complaint was filed on June 14th in the U.S. District Court for the Western District of Louisiana (Case No. 6:12-cv-1701) and is currently pending in the Actos multidistrict litigation. Proceedings are centralized before Judge Rebecca F. Doherty, and Jerrold S. Parker, founding partner of Parker Waichman, has been appointed to the Plaintiff?s Steering Committee. According to the complaint, the Plaintiff took Actos from 2004 and 2007; she developed bladder cancer around April 2006. The lawsuit alleges that Actos caused the bladder cancer, claiming that the Defendants were aware of this risk but did not inform the public. As a result of their negligent and/or fraudulent actions, the lawsuit is alleging severe mental and physical pain and suffering, past and future permanent injuries and emotional distress, economic loss due to medical expenses and living related expenses as a result of a new lifestyle. The suit also claims loss of consortium on behalf of the Plaintiff?s husband.

Actos is a medication approved to treat type 2 diabetes, a condition where the body fails to produce an adequate amount of insulin or does not utilize insulin efficiently. As a result, the body is unable to break down glucose for energy. Actos is intended to treat this problem by increasing the body?s sensitivity to insulin.

Actos was originally launched by Takeda and Eli Lilly. According to the lawsuit, Takeda announced the end of this joint venture in April 2006.

Actos was suspended in France and Germany last June, after a study funded by the French Medicines Agency found that using Actos for one year was linked to an increased risk of bladder cancer in men. Days later, the U.S. Food and Drug Administration (FDA) announced that the Warnings and Precautions section of the label for Actos and other pioglitazone-containing medications would be changed to address a potential increased risk of bladder cancer. According to the agency?s Safety Announcement, use of Actos for one year was linked to an increased risk of 40 percent. This past April, Health Canada made similar changes to the Actos label. Recent studies continue to support the link between the diabetes drug and bladder cancer. Late last month, Canadian researchers found that use of Actos for two years was associated with a two-fold increased risk. The study was published in the British Medical Journal. National Survey Reveals Impact of ADHD in Adults

Titusville, NJ (PRWEB) September 18, 2008

Adults diagnosed with Attention Deficit Hyperactivity Disorder (ADHD) say that having ADHD significantly impacts their ability to focus at work, as well as their responsibilities at home and their relationships. These findings were according to a national survey including more than 1,000 adults across the United States diagnosed with the condition.

McNeil Pediatrics?, Division of Ortho-McNeil-Janssen Pharmaceuticals, Inc, sponsored the survey as part of its commitment to the ADHD community’s 2008 National ADHD Awareness Day.

ADHD is thought to affect about 9 million adults in the United States, and research on the life span of the condition notes the disorder can impair academic, social and occupational functioning, and is often associated with academic underachievement, conduct problems, underemployment, motor vehicle safety and difficulties with personal relationships.

“Findings from today’s survey underscore the impact ADHD can have for adults who are struggling to cope with and manage this condition at work, at home and in their relationships,” said Dr. Edward Hallowell, a practicing psychiatrist and founder of the Hallowell Center for Cognitive and Emotional Health in Sudbury, Mass. “As a psychiatrist who has treated adults with the condition for more than 25 years, and as an adult who was diagnosed with ADHD at age 31, I know firsthand the importance of working with a healthcare professional to identify strategies that may be effective in controlling ADHD symptoms, such as behavioral modifications and medication.”

The survey findings on adults with ADHD reinforce previous findings from a recent World Health Organization (WHO) report, which concluded ADHD is a relatively common condition among working adults and is associated with impairment and work performance. The WHO survey also found that only a small number of employed adults with ADHD are being treated for the condition, even though evidence shows medication can be effective in improving ADHD symptoms, and that on average, adult workers with ADHD miss more than three weeks a year in workplace productivity.

Adult ADHD Survey Findings

Conducted by Harris Interactive on behalf of McNeil Pediatrics?, key survey findings included a variety of participant perspectives, including:

????Most adults with ADHD agree that having the condition strongly affects their performance in multiple areas of their lives, including:
o????Their responsibilities at home (65 percent)

o????Their relationships with family and friends (57 percent)

o????Their ability to succeed at work (56 percent of those employed)

????Up to half (50 percent) of those employed worry ADHD symptoms affect opportunities for promotion, and the majority feel they have to work harder (65 percent) and/or longer (47 percent) than their co-workers to accomplish similar work.

????Three-quarters of respondents said their ADHD symptoms strongly affect their ability to stay on task at work (75 percent), while others listed challenges such as:
o????Concentrating on what others were saying (70 percent)

o????Wrapping up projects (61 percent)

o????Following through on tasks (61 percent)

o????Sitting still in meetings (60 percent)

o????Organizing projects (59 percent)

????Just as their needs differ, adults with ADHD report divergent goals in managing ADHD symptoms. In selecting their top three goals for managing the condition, half cited being able to finish projects and tasks (51 percent), and getting their household more organized (51 percent). Other top-three goals included:
o????Feeling less irritable and upset (38 percent)

o????Getting personal finances more organized (28 percent)

o????Improving personal relationships (26 percent)

o????Feeling calmer and to feel less need to always be moving (22 percent)

o????Getting along better with others in social situations (20 percent)

????One-third (36 percent) feel their ADHD symptoms are not under control, and many more (58 percent) are not satisfied with their ability to handle stress.
o????Of those whom symptoms are not under control, 54 percent feel like a failure for it.

????One-third (37 percent) get depressed thinking about how hard ADHD is to deal with.

Adults with ADHD who participated in the survey also reported utilizing a variety of techniques to help manage their symptoms. Four out of five have used visual reminders, such as post-it notes, to help manage their ADHD symptoms. Those in the survey also reported:

????Taking prescription medication (82 percent)
????Listening to music (75 percent)
????Using a planner or organizer (71 percent)
????Exercising (69 percent)

Of those adults on medication, four out of five (81 percent) reported that not taking medication negatively impacts their work or home performance. Patients on medication said they are focused primarily on goals of symptom control and improving performance at work (74 percent), at home (69 percent) and in relationships (62 percent).

“I was diagnosed two years ago after I realized that some of the stress I felt from trying to keep up with my career, home and family might be more than stress,” said Natalie Knochenhauer, a former public defender, non-profit executive and founder of the Metro Philadelphia Chapter of Children and Adults with Attention Deficit Hyperactivity Disorder (CHADD), and advocacy chair of Pennsylvania CHADD. “After my diagnosis, I felt like I had extra hours in every day to accomplish what I needed to get done. Because of the clear benefits I have experienced, I work closely with my doctor to manage my condition, which enables me to perform better in all aspects of my life.”

NAPW Minneapolis-St. Paul Local Chapter Showed Contributions to Local and National Charities

The NAPW Minneapolis-St. Paul Local Chapter gathered on May 15th at 3:30pm for their monthly professional networking meeting at 3 Tiers Bakery. The Chapter discussed their new referral program and ways to stay active within the community and around the globe.

Sabra Brown, Minneapolis-St. Paul Local Chapter President, kicked off the meeting by welcoming all attendees and asked members to network and introduce themselves .

First to speak was Sabra Brown , who is the Chief of Public Affairs for the 934th Airlift Wing. Her unit is the only Air Force Reserve wing in the state and is host to approximately 5,000 Army, Navy, Air Force, Marine Reservists, and the Air National Guard.

Faith Richardson works for the Nacel Open Door. Faith?s organization places foreign exchange students in American homes. This cultural exchange program supports over 4,000 students and families, coming from more than 20 countries.

Kris Pearson is Realtor Senior Advisor for Keller Williams Integrity Realty Lakes. Her specialty is helping seniors sell their homes when they have to move to a senior living community.

Cindy Miller is the Owner of Mystic Bookkeeping. Cindy?s skills and area of expertise are in nonprofit, bookkeeping, and consulting. She joined NAPW-MSP to meet with like-minded, professional women who could offer advice on work/life issues.

Genevieve Frazier is an insurance agent with Maguire Agency in Minnesota.

Karen Miller is an Associate Director of Partners in Prevention-Reducing Heart Attack and Stroke in Minnesota at the University of Minnesota.

Sabra Brown described the networking and continuing education opportunities NAPW offers. She also discussed the member benefits of being a part of NAPW , such as the free or discounted seminars and training courses throughout the Twin Cities.

?The NAPW National Networking Conference will be a great opportunity for Minneapolis chapter members to network with some influential women in business and leadership positions,? said Sabra. ? There will be influential women speakers at the conference such as Sara Blakley who is the Founder of Spanx, and Star Jones who is an actress, advocate , and the spokeswoman for NAPW.?

The group conveyed interest in attending women?s fundraising events such as breast cancer awareness walks and domestic violence fundraising lunches. The Chapter is currently looking for a volunteer to head up that program withing NAPW-MSP. Sabra relayed to the group that any volunteers should coordinate with the president.

Members are encouraged to use the NAPW-MSP FaceBook, Twitter, and Linked In accounts to

post information about upcoming events or news.

The Chapter will continue to collect clothing for Ready For Success, a locally managed organization that collects business attire for Minnesota and St. Paul women who need help with professional clothing.

“We will continue to collect DVDs and magazines to send to deployed military personnel in Southwest Asia at every meeting to help those in need,” said Sabra.

These will then be sent by mail. They have already adopted one female military member and will look at ?adopting? more as funds and donations allow.

The group discussed the new Refer-A-Friend program locally. If an NAPW member refers a friend and they sign up, they will receive a Metro Dining Club card worth hundreds of dollars in discounted and free meals at participating restaurants throughout the Twin Cities.

Upcoming meetings were discussed and their next Simply Networking event is to be held June?s meeting is to be hold on June 6th at 10:00-11:00am at Skywater located at 1001 Marquette Ave Minneapolis, MN 55403 MN) from 5-6pm. July?s meeting is to be held on July 14th at 10:00-11:00am at Good Earth located at 70th and France, The Galleria, Edina MN 55435.

Sabra Brown thanked everyone for attending and encouraged women to bring a friend to the next meeting.

Students, ages 19 or younger, are eligible for the $ 1,000 award. Candidate must demonstrate initiative, talent and determination resulting in a notable accomplishment in any field, including art, music, math, athletics, or community service.

Teachers, coaches, mentors, parents or students themselves are invited to submit an application. Application forms are posted on the organization’s website. Contest deadline is January 31, 2009. Applications from Canada are also welcome.

The winner will be expected to attend the awards ceremony, to be held during the annual benefit gala on Saturday, April 25, 2009, in Fairfield County, Connecticut. Transportation and hotel accommodations will be provided for the winning student and his/her parents.

Honorable Mentions will also be awarded, though attendance will not be required.

Henry Winkler, author of the Hank Zipzer books featuring a hero with learning disabilities (LD) and attention-deficit hyperactivity disorder (ADHD), will also be honored at the event, according to Jane Ross, Executive Director of Smart Kids with Learning Disabilities, Inc.

“Henry Winkler is perhaps better known as “The Fonz,” the highly popular fictional character on Happy Days, which resulted in at least two Golden Globe Awards for best TV actor for Winkler,” said Jane Ross. “What may be less known about Henry Winkler is that he grew up struggling with dyslexia. We are proud to be honoring him during our annual benefit gala and Youth Achievement Awards presentation. We are proud to celebrate the strengths and accomplishments of both adults and students with learning disabilities and ADHD.”

Last year, the winner of the 2008 Youth Achievement Award was 19-year-old Evan Paul of Lynnfield, MA, a sophomore at the University of Arizona in Tucson and CEO of egameplace.com, a videogame-trading site he set up at age 15. He is also the co-founder of Dyslexic Dreams, a nonprofit supporting young people with dyslexia.

Honorable Mentions in 2008 were awarded to six students from Huntsville, TX, Rockville, MD, Colorado Springs, CO, Savannah, GA, Trumbull, CT and Bethesda, MD.

The Zadroga 9/11 Health and Compensation Act, which became law in December 2010, was named after deceased New York Police Department detective James Zadroga, who had worked at Ground Zero. Many of the individuals who participated in the rescue and recovery efforts following the 9/11 terrorist attacks have since been diagnosed with various illnesses because of their exposure to toxic dust. The Zadroga Act reopened the September 11th Victim Compensation Fund for five years to provide payment for job and economic losses for first responders, those trapped in the buildings, and local residents, who suffered illness or injuries related to the toxic dust. Previously, NIOSH had declined to include any cancers in the list of illnesses covered under the Zadroga Act, purportedly because of a lack of scientific evidence linking the disease to exposure to Ground Zero toxic dust. That decision left many cancer-stricken Ground Zero first responders who are too sick to worker and without health insurance without any recourse, according to Matthew McCauley, lead attorney in the WTC/Zadroga group at Parker Waichman LLP, and a former NYPD Officer and WTC First Responder.

In the past year, evidence linking Ground Zero toxic dust exposure to various cancers has grown. Last year, a large study of New York City firefighters published in The Lancet found a 19% increase in cancer risk overall in those who responded to the 9/11 terrorist attacks. In March, during a hearing convened by the World Trade Center Health Program Scientific/Technical Advisory Committee, Dr. Philip Landrigan, a dean at the Mount Sinai School of Medicine, testified that a yet-to-be published study conducted by his team revealed a 14 percent increase in cancer rates among rescue workers, including significant increases in prostate, thyroid and certain blood cancers. The study was the largest of its kind, involving 20,000 firefighters and police officers as well as sanitation workers, construction workers and others who assisted at Ground Zero after the terror attack. Based in part on this research, the World Trade Center Health Program Scientific/Technical Advisory Committee recommended in March that dozens of cancers be added to the list of covered illnesses covered under the Zadroga Act. National Institutes of Health (NIH) Has Presented New Findings on the Usefulness of an Omega-3 Diet in Optimizing Mental Health, Says Nutri-Med Logic Corp.

However, the new findings points to a fundamental role for “DHA of omega-3″ in mental health protection.

According to the NIAAA researchers, while American Psychiatric Association has been recommending Omega-3 as an adjunctive therapy for mood disorders, they are suggesting new research to establish a definitive role for its use in the “stand alone treatment” of depression.

The NIAAA study is seeking to incorporate Omega-3 into the diet of the U.S. military, especially those in deployment situation, in our opinion, confirming the role of DHA of Omega-3 for moderation of stress.

Stress, be it psychological or physiological (age-related) produces a hormone called cortisol. Clinical studies have shown, going back to 1966, that cortisol increases the activity of an enzyme called “tryptophan pyrrolase”, which degrades tryptophan. (1)

Tryptophan is an essential amino acid, which is the raw material for the mood hormone (Serotonin). Lack of Serotonin has been implicated in Depression, bipolarity and anxiety. (2,3,4)

While, the relationship between the low levels of DHA of Omega-3 and high levels of stress is well established, but stress is not the only cause for the degradation of tryptophan and the NIAAA study did not analyze the inflammation biomarkers in the older generation of the active service members. Obviously, the younger generation would rarely have problem with inflammation, and as support thereof, we cite disease state such as Arthritis, Osteoporosis, Obesity, etc., which generally surface with age.

Inflammation also plays a role in degradation of tryptophan, which is mostly seen noted by age.

Pro-inflammatory agents such as IL-1 or TNF-Alpha increase the activity of the enzyme Indoleamine Dioxygenase (IDO), which degrades tryptophan. (5)

The EPA of Omega-3 is the precursor to Resolvin E1, a potent anti-inflammatory. Roslvin E1 was discovered in 2006 by a team of researchers of Harvard Medical School.

While the DHA of Omega-3 is equally important for all generations, young and old, the EPA of Omega-3 is highly important with the aging.

The human body is incapable of producing Omega-3. It must be supplemented by the diet. Omega-3 is mainly found in cold-water fishes.
